These Terms of Use (referred to as "Terms") regulate your utilization of Koalo, except where explicitly indicated that separate terms (and not these Terms) are applicable. They also furnish details regarding the Koalo service (referred to as the "Service"), as delineated below. By creating a Koalo account or engaging with Koalo, you are consenting to these Terms of Service.

The Koalo Service is among the offerings extended to you by Koalo UG (haftungsbeschränkt). Consequently, these Terms of Use establish an accord between you and Koalo UG.

The Koalo service

We are dedicated to delivering the Koalo Service, encompassing all Koalo products, features, apps, services, technologies, and software designed to advance Koalo's mission: Empowering creators and fostering knowledge sharing in a social, accessible manner. The service encompasses the following components:

  1. Curated Content and Connections: We aim to connect you with engaging users and content aligned with your interests, enhancing your experience on Koalo with enriching and educational content. We're continually refining our systems to offer you more tailored content and connections in the future.

  2. Verified Creators and Quality Content: On Koalo, only verified users, known as 'creators,' have the privilege to upload content. This verification process ensures platform quality and content authenticity. Users, regardless of creator status, can engage with content by sharing, saving, rating, and reusing it from other users and creators.

  3. Positive and Inclusive Environment: We're committed to fostering a positive, inclusive, and safe space for our community members. We provide tools and resources to support positive interactions, and we encourage reporting of abuse or policy violations. Your security is paramount, and we may collaborate with law enforcement agencies to address harmful behavior.

  4. Technological Advancements: Organizing and analyzing information is crucial for serving our growing community. We leverage cutting-edge technologies such as artificial intelligence and machine learning to personalize, protect, and enhance our service on a global scale. Automated techniques ensure the functionality and integrity of our platform.

  5. Global Access: Operating a global service requires data storage and transmission across various locations worldwide, including countries outside your residence. This global infrastructure is vital for providing seamless access to our Service and may involve affiliated companies owning or operating infrastructure.

  6. Research and Innovation: We utilize user data to drive innovation and improve our service continually. Through research and collaboration, we strive to enhance user experience, develop new features, and contribute to the well-being of our community. This includes data analysis, user behavior research, and feature testing to optimize our platform.

At Koalo, we are committed to providing a dynamic and enriching experience, empowering creators, and fostering a vibrant community focused on knowledge sharing and collaboration.

This is how our service is financed

To access the full suite of Koalo's app-building services, a one-time fee of $120 is required. For enterprise clients seeking custom solutions tailored to their specific needs, personalized pricing based on features is available upon request.

Additionally, Koalo operates on a revenue-sharing model, where we retain a small nominal percentage fee from every subscription made to a creator's app. This ensures a fair and sustainable partnership between Koalo and our valued creators.

In order to provide our service, it is necessary for us to collect and use your information. The Data Policy explains how we collect, use and share information. It also describes the many ways you can control your information, including in Koalo Privacy and Security Settings.

At Koalo, we're dedicated to providing a safe, inclusive, and enriching online environment where creators and their communities can thrive. By using our service, you agree to adhere to the following guidelines and commitments, ensuring a positive experience for all members of our community.

Who Can Use Koalo

We welcome individuals of all backgrounds to join our platform, but certain criteria must be met to maintain the integrity of our community:

  • Age Requirement: Users must be at least 13 years old to use Koalo.

  • Legal Compliance: Users must not be prohibited by law from using our services or engaging in payment-related activities.

  • Account History: Users must not have had their Koalo account disabled previously for policy violations.

  • Criminal Background: Users must not be convicted sex offenders.

Acceptable Use of Koalo

To foster a safe and open environment for all users, we expect everyone to adhere to the following guidelines:

  • Authenticity: Users must provide accurate and current information, including registration details. Impersonation or creation of accounts on behalf of others without consent is prohibited.

  • Legal Compliance: Users must not engage in illegal, misleading, or fraudulent activities on Koalo.

  • Compliance with Terms: Users must abide by Koalo's Terms of Use and Community Guidelines, refraining from actions that violate these policies or assist others in doing so.

  • Service Integrity: Users must not disrupt or interfere with the intended operation of Koalo, including abusing reporting mechanisms or attempting unauthorized access.

  • Account Transactions: Users must not sell, license, or purchase Koalo accounts or data obtained from our service without authorization.

  • Privacy and Rights: Users must respect the privacy and rights of others, refraining from posting private or confidential information or infringing on intellectual property rights without permission.

Permissions Granted to Koalo

To provide our service effectively, we require certain permissions from users:

  • Content License: While users retain ownership of their content, they grant Koalo a license to use, host, distribute, modify, and display their content for service provision.

  • User Information: Users agree to Koalo's use of their username, profile picture, and activity information for service-related purposes.

  • Service Updates: Users consent to Koalo downloading and installing updates to the service on their devices.

Additional Rights Reserved by Koalo

Koalo retains certain rights to ensure the integrity and operation of our service:

  • Username Changes: Koalo reserves the right to change a user's username if deemed necessary.

  • Intellectual Property: Koalo retains all rights to its intellectual property and trademarks, permitting user use only as expressly permitted.

  • Modification and Assignment: Koalo may modify or assign its rights and obligations under this Agreement with proper notice to users.

Content Removal and Account Management

Koalo reserves the right to remove content or deactivate/suspend user accounts if they violate our policies or pose a risk to our community or services. Users can request account deactivation or content deletion, subject to certain conditions and timelines outlined in our policies.

Our Agreement

This Agreement outlines the terms of use and responsibilities for both users and Koalo. Certain features or services may have additional terms that users must agree to. Users are responsible for adhering to this Agreement and acknowledging their rights and obligations under it.

Rights and Liabilities

Koalo's liability is outlined in accordance with statutory provisions, with limitations on liability for certain types of damages and breaches. Users are responsible for understanding their rights and responsibilities under this Agreement.

Dispute handling

At Koalo, we value transparency and fairness in resolving disputes that may arise in connection with your use of our service. Please review the following guidelines regarding dispute resolution based on your user status:

For Consumers:

If you are using our service as a consumer and a claim or dispute arises, you have the right to bring your claim or dispute against us to any court in the country of your principal residence that has jurisdiction over the matter. Similarly, we reserve the right to bring our claim or dispute against you to the same court. In such cases, the laws of your country of residence will apply, without regard to conflict of law provisions.

For Business or Commercial Users:

If you are using our service for any business or commercial purpose and a claim or dispute arises between us, you agree to resolve such claim or dispute in a court of competent jurisdiction in Germany. German law will apply to the resolution of the claim or dispute, without consideration of conflict of law provisions.

These dispute resolution guidelines ensure that claims or disputes are addressed promptly and fairly, with the appropriate legal framework applied based on the nature of your use of the Koalo service. Thank you for your understanding and cooperation in adhering to these guidelines.

Unsolicited material sent in

We always welcome feedback or other suggestions, but we may use them without any restrictions or obligation to compensate you. Furthermore, we are not obligated to keep them confidential.

Update of these terms of use

Updates to Terms of Use

As part of our commitment to providing a seamless and user-friendly experience, Koalo may need to update our Service and policies from time to time. Consequently, we may also need to make changes to these Terms of Use to ensure they accurately reflect our evolving Service and policies.

We assure you that any changes to these Terms of Use will only be made if the existing terms are no longer accurate or complete, and if the proposed changes are reasonable for you, considering your interests as a user. We will notify you of any such changes at least 30 days before they become effective, providing you with an opportunity to review the updated Terms of Use before they take effect. This notification will be delivered through our Service or other appropriate channels.

By continuing to use the Service after the updated Terms of Use have become effective, you signify your agreement to be bound by the revised terms. However, if you do not wish to agree to these or any updated Terms of Use, you have the option to delete your account. We value your continued support and understanding as we strive to enhance your experience on Koalo.
