These Terms of Service ("Terms") govern your use of the Koalo service (the "Service") provided by Whyzzer UG ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Service Description
Koalo provides a platform for creators and communities to launch their own community apps. The Service includes various plans with different features, services, and usage rates, offered on a subscription basis with additional fees for any usage overages per monthly active user.
2. Account Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account, whether or not you have authorized such activities or actions.
3. Subscription Plans and Billing
a. Subscription Plans
We offer various subscription plans that provide different levels of access to the Service's features. Details of these plans, including pricing and features, are available on our website.
b. Billing
Subscriptions are billed on a recurring basis, either monthly or annually, depending on the plan you choose. By subscribing, you authorize us to charge your chosen payment method for the subscription fees and any applicable taxes.
c. Usage Overages
If your usage exceeds the limits of your chosen plan, you will be charged additional fees based on the number of monthly active users over the plan's limit. These overage fees will be billed in the same manner as your subscription fees.
4. Cancellation and Termination
You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing period. We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you create, upload, and share through the Service. You must not use the Service to:
- Violate any applicable laws or regulations.
- Infringe the intellectual property rights of others.
- Transmit any harmful or malicious code.
- Engage in any activity that could harm the Service or its users.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Whyzzer UG and its licensors. The Service is protected by copyright, trademark, and other laws of both the Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Limitation of Liability
To the maximum extent permitted by applicable law, Whyzzer UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available via the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
